Terms of service

These Terms of Service (“Terms”) govern your access to and use of the Yekta Expertise website, products, services, and related features (collectively, the “Services”). In these Terms, “Yekta Expertise,” “we,” “us,” and “our” refer to Yekta Expertise.

By accessing the Services, creating an account, or placing an order, you agree to these Terms. If you do not agree, you must not use the Services.

1. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Services or make a purchase. If you use the Services on behalf of a business or another organization, you confirm that you have authority to bind that organization to these Terms.

2. Accounts

Certain features may require an account. You agree to provide accurate, complete, and current information and to keep your login credentials confidential.

You are responsible for activity conducted through your account. Please notify us promptly if you believe your account has been accessed or used without authorization.

We may suspend or terminate an account where reasonably necessary to protect the Services, enforce these Terms, prevent fraud or misuse, or comply with legal obligations.

3. Products and Services

We make reasonable efforts to present product descriptions, specifications, images, availability, and other information accurately. However, colours, appearance, measurements, and packaging may vary, including because of screen settings, manufacturing changes, or other factors.

Product availability is not guaranteed. We may limit quantities, correct errors, update product information, or discontinue products at any time. Any material change affecting an order already accepted will be handled in accordance with applicable law.

Customers are responsible for reviewing the complete product listing before purchasing, including any product-specific eligibility requirements, limitations, warnings, return conditions, or exceptions.

4. Orders

Submitting an order is an offer to purchase the selected products. An order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been accepted.

We may reject or cancel an order for legitimate reasons, including product unavailability, pricing or listing errors, suspected fraud, payment problems, shipping restrictions, or violations of these Terms. If we cancel an order after receiving payment, we will refund the applicable amount.

You are responsible for ensuring that your billing, contact, and delivery information is accurate before placing an order.

5. Prices, Taxes, and Payment

Prices are displayed in the currency identified at checkout and may change without notice. The price charged will be the price shown when the order is submitted, subject to the correction of obvious errors and applicable law.

Taxes, shipping charges, duties, customs fees, and other applicable costs will be displayed or calculated where available. Customers remain responsible for charges identified as their responsibility during checkout or required by the destination jurisdiction.

You authorize us and our payment providers to charge the payment method selected at checkout for the total amount of your order. We may use third-party payment processors, whose separate terms and privacy practices may apply.

6. Shipping and Delivery

Delivery dates and transit times are estimates unless expressly stated otherwise. Delays may occur because of carriers, customs processing, supply disruptions, weather, incorrect delivery information, or circumstances outside our reasonable control.

Customers must provide a complete and accurate delivery address. Additional costs resulting from incorrect information, refused delivery, or failure to receive a shipment may be charged where permitted by law.

Risk of loss and ownership of products transfer as provided by applicable law and the shipping terms presented during checkout.

7. Cancellations

Customers may request cancellation only within one hour after placing an order. Requests submitted more than one hour after an order is placed will not be accepted, including where the order has not yet shipped.

A cancellation request made within the one-hour period is not guaranteed if the order has already been processed or fulfilled. Customers should contact Yekta Expertise immediately and provide their order number and relevant details.

8. Returns and Refunds

Eligible products may be returned within a maximum of 14 days after delivery. Some products have different return conditions or are excluded from returns. Customers must review the relevant product listing for specific return eligibility, requirements, exceptions, and conditions.

A mandatory restocking fee equal to 10% of the product’s purchase price will be deducted from every approved return unless Yekta Expertise confirms that the product was defective when delivered.

Returns, refunds, defective-product claims, and cancellations are also governed by our Return, Refund, and Cancellation Policy, which forms part of these Terms. If a product listing contains valid product-specific return conditions, those conditions will apply to that product.

Nothing in these Terms limits a consumer right that cannot legally be waived or excluded.

9. Acceptable Use

You must not:

• Use the Services for unlawful, fraudulent, or abusive purposes.

• Provide false information or impersonate another person or organization.

• Interfere with the operation, availability, security, or integrity of the Services.

• Attempt to gain unauthorized access to an account, system, network, or data.

• Introduce malware, malicious code, or other harmful technology.

• Scrape, copy, reproduce, or commercially exploit the Services through automated means without our written permission.

• Circumvent purchasing limits, security controls, or access restrictions.

• Infringe the intellectual-property, privacy, or other legal rights of any person.

10. Intellectual Property

The Services and their contents—including text, graphics, branding, logos, photographs, designs, software, and other materials—are owned by or licensed to Yekta Expertise and are protected by applicable intellectual-property laws.

We grant you a limited, personal, non-exclusive, non-transferable, and revocable right to access and use the Services for lawful purposes. No ownership rights are transferred to you.

You may not reproduce, modify, distribute, sell, license, publicly display, or create derivative works from our content without prior written permission, except where permitted by law.

11. Reviews and Customer Content

If you submit a review, photograph, comment, suggestion, or other content, you confirm that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights.

You grant Yekta Expertise a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, adapt, and distribute that content for operating, improving, and promoting the Services, subject to applicable privacy law.

We may remove customer content that violates these Terms or applicable law. We are not obligated to publish or retain submitted content.

12. Third-Party Services and Links

The Services may contain links to or integrations with third-party websites, carriers, payment providers, or platforms. We do not control and are not responsible for third-party services, content, availability, or practices. Your use of those services may be governed by separate terms and policies.

13. Privacy

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy. By using the Services, you acknowledge that your information will be handled as described in that policy and as permitted by applicable law.

14. Disclaimers

To the fullest extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, secure, accurate, or free of errors.

Any product warranty expressly provided in a product listing or by a manufacturer will apply according to its terms. Except for express warranties and rights that cannot legally be excluded, we disclaim implied warranties to the fullest extent permitted by law.

Product information provided through the Services is general information and should not be treated as professional advice unless we expressly state otherwise.

15. Limitation of Liability

To the fullest extent permitted by law, Yekta Expertise and its owners, directors, employees, contractors, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential losses arising from or connected with the Services or a product purchased through them.

Where liability cannot be excluded, our aggregate liability will be limited to the greater of the amount paid for the product or service giving rise to the claim and the minimum amount required by applicable law.

These limitations do not apply to liability that cannot legally be limited or excluded, including any liability arising from fraud, wilful misconduct, or other categories protected by applicable law.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Yekta Expertise and its owners, directors, employees, contractors, and service providers from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your infringement of another person’s rights.

This section does not apply to the extent a claim was caused by Yekta Expertise or where indemnification is prohibited by law.

17. Suspension and Termination

We may restrict, suspend, or terminate your access to the Services if you materially violate these Terms, misuse the Services, create legal or security risks, or engage in suspected fraud.

Provisions that by their nature should continue after termination—including intellectual-property, liability, dispute, and payment provisions—will remain in effect.

18. Changes to the Services or These Terms

We may update the Services and these Terms from time to time. When required, we will provide notice of material changes and update the effective date above.

Changes will apply prospectively from their stated effective date. The Terms in effect when an order was placed will continue to govern that order unless a change is required by law or agreed to by both parties.

19. Governing Law and Disputes

These Terms are governed by the laws of Ontario and Canada, without regard to conflict-of-law principles.

Subject to any mandatory consumer rights, the courts located in Toronto, Ontario, Canada will have exclusive jurisdiction over disputes arising from these Terms or the Services.

Before starting formal proceedings, you and Yekta Expertise agree to make a reasonable effort to resolve the dispute by contacting the other party and describing the issue and requested resolution.

20. General Provisions

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of our right to enforce it later.

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations as part of a merger, acquisition, corporate reorganization, sale of assets, or other lawful business transaction.

These Terms, together with the policies and product-specific conditions incorporated into them, form the entire agreement between you and Yekta Expertise regarding the Services.
